Article 1: Legal information

Owner of the Site and the Services and Products sites: The owner of the Site and the Services and Products sites is AUTOBIZ.

Website publisher: The Website and the Services and Products websites are published by AUTOBIZ.

Hosting the Site and the Services and Products sites: The Site  and the Services and Products sites are hosted in the European Union by the companies :

OVH, whose registered office is located at 2 rue Kellermann, 59100 Roubaix France (tel: +33 972 10 10 07),

AWS (Amazon Web Services Inc), whose registered office is at PO Box 81226, Seattle, WA 08108-1226 (tel: (206) 266-4064, Contact: https://aws.amazon.com/fr/contact-us/)

CGP (Google Cloud Platform), headquartered at 1600 Amphitheatre Parkway Mountain View, CA 94043, USA (tel: (650) 253-0000)

As part of their service, hosting providers undertake to ensure the best possible level of accessibility. Nevertheless, the hosters reserve the right to interrupt the hosting service for the shortest possible period of time, in particular for the purposes of maintenance, infrastructure improvement, infrastructure failure or if the services generate traffic deemed to be abnormal.

AUTOBIZ and the hosting providers cannot be held responsible in the event of malfunction of the Internet network, telephone lines or computer and telephone equipment, in particular due to network congestion preventing access to the server.

Article 2: Definitions

AUTOBIZ: refers to the S.A.S with capital of €287,939, having its registered office at 4 Place des Vosges, Immeuble Lavoisier, 92400 Courbevoie, France, registered with the RCS Nanterre under number 444 238 772.

GCU: refers to these general terms and conditions of use.

Customer: means any person who has signed a contract with AUTOBIZ in order to subscribe to the Services and Products of the autobizOffice suite marketed by AUTOBIZ.

Services and Products: refers to all Services and Products, without distinction, of the autobizOffice suite, marketed by AUTOBIZ.

Site: refers to the Internet Site accessible at the following address: https://office.autobiz.com/.

User: refers to any natural person of legal age who has the legal capacity to contract and who uses the Site.

Article 3: Applicability of the GCU

These GCU are enforceable, for the clauses concerning them, against all :

Users, in their use of the Site (information on the Services and Products, information on AUTOBIZ and its Customers, news, etc.), and

Customers in their use of all the Services and Products in the autobizOffice suite marketed by AUTOBIZ (autobizCarcheck, autobizClic2Sell, autobizTrade, autobizMarket, autobizAdScan, autobizMonstock, autobizIframe, autobizClic2Buy, autobizAPI, autobizAcademy).

Article 4: Acceptance and modification of the GCU

The purpose of these GCU is to define the conditions to be respected by Users and Customers.

Therefore, by accessing and consulting the Site and/or the Services and Products sites, Users and Customers agree to be bound by all the provisions of these applicable GCU. They are therefore bound by them in their entirety.

AUTOBIZ reserves the right to modify the TOU. Any new version of the Terms and Conditions will be applicable as soon as it is published online.

As the conditions of use may be amended or supplemented at any time, Users and Customers are advised to consult them regularly.

Article 5: Description of services provided

5.1 Description of the services provided to Users on the Site

The purpose of the Site is to provide Users with the following services:

A catalogue of Services and Products offered by AUTOBIZ,

A login service for Users’ personal Customer accounts,

A contact request form, and

A form to request a demo of the Services and Products offered by AUTOBIZ.

5.2 Description of Services and Products provided to Customers

Customers have access to the Services and Products of the autobizOffice suite for which a contract in due form has been signed with AUTOBIZ.

Article 6: Obligations of Users and Customers

Users and Customers shall refrain from any action likely to alter or disrupt, in any way whatsoever, the normal operation of the Site or the Services and Products.

Similarly, any misuse of information, particularly nominative information on the Site or the Services and Products, such as surnames and first names, photos or addresses, is prohibited by the User and the Customer.

The data and services offered on the Site may only be used for personal purposes and solely in accordance with these general terms and conditions of use. They may not be used for commercial purposes, nor systematically saved, nor “spider-webbed” or analysed, nor used in any other way except for private or personal use.

Furthermore, Customers and Users undertake not to use the information on the Site or available on the Services and Products in any way other than that permitted herein, nor to resell, distribute, publish or incorporate it into online or offline offers.

Generally speaking, and without this list being considered exhaustive, Users and Customers shall refrain from :

post online or make available for consultation by any person and by any means any content that is illegal, harmful, threatening, abusive, defamatory, abusive, obscene, hateful, inciting to racial hatred or violence, invasive of the privacy of others or of human dignity or otherwise reprehensible under current legislation;

put online or make available to anyone by any means any content that they do not have the right to distribute under the laws and regulations in force;

put online or make available for consultation by any person and by any means any content infringing any intellectual property right or any other property right belonging to another person;

put promotional or advertising messages online or make them available to anyone by any means;

post content online that mentions personal information (name, address, telephone number, e-mail address) and any other information that could be used to track, identify, contact or impersonate anyone.

If this is not the case, AUTOBIZ reserves the right to take any measure to stop the infringement and to seek the liability of the perpetrator.

Article 7: Accessibility of the Site and the Services and Products sites

The Site and the Services and Products sites are accessible to Users and Customers at all times, AUTOBIZ endeavours to provide quality access.

However, AUTOBIZ may decide to interrupt the Site for technical maintenance. AUTOBIZ will do its utmost to ensure that the Site and the Services and Products sites can be used as soon as possible.

Article 8: Interactive areas

Interactive areas are available to Users and Customers:

Users can submit contact and demo requests with free text fields, and

Free fields are made available to Customers within the Services and Products made available.

AUTOBIZ reserves the right to hold its author liable, without prior notice, for any content posted in these areas that contravenes any applicable legislation.

In addition, AUTOBIZ reserves the right to hold the User or Customer civilly and/or criminally liable, particularly in the event of messages of a racist, insulting, defamatory or pornographic nature, whatever the medium used (text, photographs, etc.) and without this list being exhaustive.

Article 9: Intellectual property and counterfeiting

AUTOBIZ owns the intellectual property rights and holds the usage rights to all the elements accessible on the Site and in the Services and Products, in particular the texts, images, processes, graphics, logos, videos, icons and sounds.

Any reproduction, representation, modification, publication or adaptation of all or part of the intellectual property belonging to AUTOBIZ, by whatever means or process, is prohibited without the prior written authorisation of AUTOBIZ.

Any unauthorised use of intellectual property belonging to AUTOBIZ shall be considered as an infringement and prosecuted in accordance with the provisions of articles L.335-2 et seq. of the French Intellectual Property Code.

Article 10: Limitation of liability

AUTOBIZ shall not be held liable for any direct or indirect damage caused to the User’s or Customer’s equipment when accessing the Site and/or the Services and Products sites, and resulting in particular from the appearance of a bug or incompatibility. In addition, Users and Customers undertake to access the Site and/or the Services and Products sites using recent, virus-free equipment and with an up-to-date browser.

AUTOBIZ shall also not be held liable for any indirect damage resulting from the use of the Site and/or the Services and Products.

In addition, the Site uses the following technologies: Symfony Framework, Slim Framework, React Js, Next Js, Typescript, MariaDB, Postgress, AWS DynmoDB, Gitlab, HTML5, CSS 3, Javascript, Sass, SCSS, Bootstrap, Webpack, Babel and WordPress.

Consequently, AUTOBIZ may not be held liable for any material damage linked to the use of the Site and/or the Services and Products sites.
