Foreword – Definitions

Each of the terms mentioned below will have the following meaning in these General Conditions of Use (hereinafter referred to as the “GCU”):

autobiz SAS: means the company that edits and operates the office.autobiz.com, autobiz-market.com and sistemavo.es.

autobiz, SAS with capital of 274.7167 euros, registered in the Nanterre trade and companies register under number 440238772, whose registered office is located at 4 place des Vosges, 92400 Courbevoie.

User: means any Internet user who consults and uses the autobizOffice site.

ARTICLE 1 – PURPOSE

The purpose of the GCU is to determine the conditions of use of the autobizOffice site by the Users.

ARTICLE 2 – ACCEPTANCE

By accessing and using the autobizOffice website, all Users declare that they have read these General Conditions of Use and expressly accept them without reservation and/or modification of any kind. These GCU are therefore fully enforceable against Users.

ARTICLE 3 – USE OF AUTOBIZOFFICE SITE

The User of the autobizOffice site declares that they have the necessary means to access and use the autobizOffice site and acknowledges that:
• The reliability of the transmissions is random due, in particular, to the heterogeneity of the infrastructures and networks on which they circulate and that, in particular, failures or saturations may occur;
• It is the responsibility of the user to take any measures they deem appropriate to ensure the security of their equipment and their own data, software or other, in particular against contamination by any virus and/or attempted intrusion that they may experience;
• Any equipment connected to the autobizOffice site is and remains under their sole responsibility, the responsibility of autobiz SAS cannot be sought for any direct or indirect damage that may be incurred as a result of their connection to the autobizOffice site.

The information provided by autobiz SAS on autobizOffice is for information purposes only. autobiz SAS makes its best efforts to provide Users with reliable, available and up-to-date information but cannot guarantee the accuracy, completeness and timeliness of the information disseminated on autobizOffice.

ARTICLE 4 – INTELLECTUAL PROPERTY

4.1 All intellectual property rights (such as, in particular, copyright, neighbouring rights, trademark rights, rights of database producers) relating to both the structure and the contents of the autobizOffice website, including images, sounds, videos, photographs, logos, brands, graphic, textual, visual, tools, software, documents, data, etc. (hereinafter referred to as “Elements”) are reserved. These Elements are the property of autobiz SAS. These Elements are made available to Users, free of charge, for the sole use of the autobizOffice et website and as part of a normal use of its features. Users undertake not to modify the Elements in any way.

Any unauthorised use of the Elements results in copyright infringement and constitutes infringement. It may also result in a violation of image rights, human rights or any other rights and regulations in force. It may therefore involve the civil and/or criminal liability of its author.

4.2 It is forbidden for any User to copy, modify, create a derivative work, reverse the design or assembly or in any other way attempt to find the source code, sell, assign, sub-license or transfer in any manner whatsoever any right relating to the Elements.

Any User of the autobizOffice website commits in particular not to:
• extract, for commercial or non-commercial purposes, all or part of the information on the autobizOffice site;
• reproduce on any other medium, for commercial or non-commercial purposes, all or part of the information on the autobizOffice website.

4.3. autobiz, autobizOffice, autobizCarcheck , autobizMarket and SistemaVo trademarks and logos of autobiz SAS partners are registered trademarks. Any total or partial reproduction of these trademarks and/or logos without the prior written permission of autobiz SAS is prohibited.

4.5. autobiz SAS reserves the right to take legal action against persons who have not complied with the prohibitions contained in this article.

4.6. No hyperlink can be created to the autobizOffice site without the prior and express consent of autobiz SAS.

ARTICLE 5 – PERSONAL DATA AND COOKIES

Any processing of personal data within the scope of this Agreement is subject to the provisions of our Privacy & Cookies page Privacy & Cookies

ARTICLE 6 – MODIFICATION OF THE AUTOBIZOFFICE SITE AND THE GCU

6.1 autobiz SAS reserves the right, at any time, to modify or discontinue the accessibility of all or part of the autobizOffice website.

6.2 Autobiz SAS reserves the right to modify, at any time, all or part of the GCU. Users are invited to regularly consult these Conditions of Use in order to become aware of any changes made. The use of the autobizOffice site by the Users constitutes the acceptance, by the latter, of the modifications made to the GCU.

ARTICLE 7 – VARIOUS PROVISIONS

Should any part of the GCU prove to be illegal, invalid or unenforceable, for any reason, the provisions in question would be deemed to be unwritten, without questioning the validity of the other provisions that will continue to apply between Users and autobiz SAS.
These herewith GCU are subject to French law.
